when you buy a car on installment, you have a contract with the bank.
you may not just pass on this responsibility to someone else, without the bank's knowledge and approval.

Nag assumed kami ng car last April, upon signing nung deed of sale dun lang namin nakita na yung ka deal namin is yung "2nd owner" pala. So bale pangatlo kaming sasalo. Although ang sabi samin is pinsan daw yung first owner. So we went ahead and bought the car.

April we paid only half since we got the car mid of April na, then we paid for June and July dun sa bank ni 2nd owner since he said naka issue sya ng PDC dun sa PDC ni first owner. Around August they contacted us na may problema daw. Sinabi na declined daw ni bank mga payments kasi may problema sa car. We then met and talked about it. Sabi nila January pa daw hindi nagbayad si first owner at hindi alam ni 2nd owner. So yung payment ni 2nd owner halos interes lang pumapasok. Yung 2 and half months payments namin declined na rin "daw" ng banks since hahatakin na daw yung car..

So we talked about it, ano gagawin, 2nd owner suggested na pag hindi inayos ni 1st owner he has no choice but give us his own car na pamalit dun and sya na daw ang bahala. This was August. Exchange was supposed to be November.

dumating ang December, kinokontak na namin si 2nd owner ano gagawin since paranoid na rin kami what if may hit na yung car and bigla samin bawiin diba? Sabi ni 2nd owner may problema sya and he's bankrupt and yung car nya is nahatak na rin. So what he is suggesting now is he will sell the car that we have for low price, para at least mabawi daw pera namin. Nag DP kami 157k, plus almost 48k+ monthly payments na nasa kanya. He want to sell it for 140k daw, ibabalik samin. Halos 60k mawawala samin.

Ang hirap iexplain

Di ko na po alam gagawin.Ibigay ko na lang ba car sa 2nd owner and just get 140k back?

hold on to the car, and deal directly with the bank, po.
i don't think the second owner has any legal claim to the car.

my scheming mind is telling me, that the second owner will just get the car from you and attempt to sell it to his next victim.

He's threatening po na baka makita samin ang car ng bank and then mahatak ng bank. Wala na kami habol nyan. Di namin mababawi pera and wala rin car.

it won't matter where that car is. hahatakin yan, no matter which garage it is hidden in.

again, talk to the bank. inquire who the legal owner is. because only the legal owner has a right to sell that car.

worse comes to worst,
hold on to that car.. car is declared stolen by legal owner.. we wouldn't want to be in-convenienced by getting caught driving a carnapped car, now, would we?

Ang sabi samin ni 2nd owner, nagkakasuhan daw sila ni 1st owner. Pinapalabas daw nya na binalik ni 2nd owner yung car kay 1st owner since hindi daw maayos payment ni 1st owner. So now may mga spotter na daw bank sa place ni 2nd owner.

2nd owner wants to sell it na lang sa iba at itago sa ibang lugar that's why he's selling it so low para at least daw maibalik kahit pano pera namin.

If EVER po na we just agree to get the 140k para at least may bumalik samin na pera. My concern now is if ever po na magkasuhan sila since we had Open deed of sale, baka kami ituro na samin pa yung sasakyan. Kami pa lumabas na nagtatago sa sasakyan?

Who the **** is this second owner? Why did you trusted him so much, even with all the problems you discovered you still went ahead and deal with him?

Please tell the whole story.

We didn't know his problem until after signing the sale contract and 2nd month na nasamin na yung car. We had agent too na big seller sa facebook so we thought okay sya since sabi nung agent okay naman daw and dati nilang naging client si 2nd owner. They keep blaming the first owner for not paying bago ipasa kay 2nd owner na hindi "daw" alam na may lapses sa payment.
