Perhaps one of our law practitioners can shed a light on this topic. You are on a plane and you give birth in US territory, what is the citizenship. What if you're in the middle of pacific ocean?

July 4th, 2018 07:07 PM #27Sir yung mapaaga na term ko is yung uwi namin(Tentative kasi na sched ng uwi is nasa 32-33 weeks sya)So kung incase matuloy kami at nandun na kami at gusto namin umuwi ahead sa tentative sched eh resched na lang ng flight pauwi .. Hindi yung panganganak ni misis.. At gaya nga ng sabi ko, out of the equation na na manganak sya doon kasi sa tingin ko talaga hindi worth it.. Kaya uwi sya ng Pinas para manganak.. Pero salamat sa advice malaki tulong nito sa amin.. Ipapabasa ko lahat ito kay esmi para hindi nya sabihin na bias ako sa decision making kung sakali ako na lang at yung anak namin pupunta..hehe
Yup.. Hindi covered panganganak pero dahil sa mga advice nyo dito kaya we decided na every travel na namin Outside PH is kuha na kami travel insurance..

this is private international law.
the philippines follows JUS SANGUINIS (right of blood) by virtue of which citizenship is determined not by place of birth but by the citizenship of the parents.
on the other hand, the US adheres to the principle of JUS SOLI (law of the soil). under this concept, citizenship of a person is determined by the place where he was born.
so, if a Filipina gives birth in the US territory, the baby actually has dual citizenship. in the eyes of philippine law, he is a filipino, but to the americans, he is american.
if he was born in the middle of the pacific, let us apply the principle of exterritoriality. airplane is an extension of the country whose flag it flies. so, it depends. if it is PAL, then he is a filipino. if american airlines, he's american.
