Ayaw na magrepy o sumagot ung seller pag tinatanong ko sya sa history etc ng oto... Baka kasi may kaso o violation o anuman sangkot ung oto... Damay po ba ako dun at dba mgkaproblema sa pagbenta ulit nun? Nabigla ksi ako sa pagbili 1st time mgka oto... Dko na usisa ng maigi ung papeles...

From what I understand with open deed of sales, as long as you have a photocopy of the ID of the owner indicated on the OR/CR including 3 specimen signatures, you'll be fine.

sa rehistro walang problema.. kahit naman hindi naka pangalan sayo mare rehistro mo...

ang problema mo hindi mo malilipat sa pangalan mo yang rehistro kasi wala kang deed of sale.. at hindi mo din mabebenta kasi hindi naman sayo naka pangalan yung CR.. kontakin mo yung seller and papirmahin mo sa Deed of Sale.

Walang signature ng registered owner, walang consent, ergo, walang sale. Ibig sabihin, technically, the vehicle is still the property of the registered owner. Hanapin nyo na lang ang registered owner at papirmahin. Hopefully malocate nyo at buhay pa or di pa pumunta sa ibang bansa.

Regarding IDs.. Kaya naman sinasamahan ng photocopy ng IDs ang open deed of sale dahil pag ipa notaryo na yan, yung IDs ang basehan ng notary public na buhay pa yung seller i.e. security siya ng notary public. Although notarizing a deed of sale in the absence of any of the two parties (the seller and buyer) is still a dishonest and irregular act which has caused the disbarment of not a few lawyers. Pero sige pa rin dahil nasasayangan sila sa fee.

Di mo naman kailangan ang IDs na yan sa pag transfer ng registration. Ang importante lang ay yung notarized deed of sale.

Baka may nakaka alam, ask ko lang.

We got a repo unit, bali nakuha namin eto sa buy and sell instead of directly sa bank.

Para ma transfer sa amin yung ownership (Oct 2016 acquired unit based sa or/cr), registration ata next month due, ano yung need naming documents?

1. Deed of sale (Anong deed of sale need ba namin, between us and the buy and sell (we already have this) and/or between the bank/first owner and the buy and sell?) When the bank sold it to the buy and sell, ang ang seller ba in the DOS is the bank?

2. Orig or/cr - better if wala ng encumbrance, if meron, need lang na namin is release of chattel mortgage from the bank?

The buy and sell told us that they will give us the papers from the bank in 3-4 weeks. Haven't asked yet kung anong documents specifically yun.

Kailangan mo deed of sale ng bank to the bayanseller, deed of sale bayan seller to you.

Corp secretary cert ng bank

Kailangan mo ng affidavit of surrender or yung court docs na foreclosed yung auto.

Kalangan ddin cert cancellation of mortgage

Then punta ka sa registry of deeds kung saan originally nakarecord yung utang. Hassle din ito samin kasi batangas pala yung nabili naman, eh farview kami.

Then hpg clearance

Then punta ka sa lto kung asaan ang mother file

We got it for a low price naman plus may warranty pa sa CASA, I guess worth the effort. Lol
