the real question that should be asked is not whether or not corona will be impeached but rather has the prosecution proven its case for impeachment
if one believes that the prosecution has proven its case, then impeachment is a triumph of justice
but if the prosecution has not proven its case yet corona is impeached, then it is all a mere political game
one wins a case not the the weakness of the evidences of the other side but on the strength of your own evidences
this is an age old maxim in law
and, the senator-judges are supposed to be neither for the prosecution or the defense

The law is unambiguous. As explained here and elsewhere, the FCDU prohibits third parties from divulging dollar accounts.
It's impossible for the law to prohibit a person from divulging personal information. Even more impossible for it to prohibit a person from divulging personal information that he is required to divulge by law. In Corona's interpretation, he is now himself guilty of violating the FCDU!And not in the performance of his duty as a public official... so, in his interpretation, should he now go to jail for that?

While I agree that some of the SC's decisions have been good... others have... not... just look at the farce that is the PALEA case. And as you say, it's a disproportionate response of the Aquino administration to take on the Chief Justice for decisions that were voted upon by the entire SC. And the case for the prosecution in other terms (the GMA decisions, etcetera) was very weak. And yes, some of the prosecution's tricks were underhanded.
But you can't hide behind politics. If you are given a traffic ticket simply because an enforcer doesn't like you, as long as it's a valid ticket for a proven offense (say, speeding with a photo and radar reading), then you have to pay the fine.
And non-declaration of assets is a valid offense that means dismissal and has meant dismissal for other officials, already.
Magkasagutan nalang mamaya sa ibang court hearings and lawsuits regarding what went on during the trial, if libel and defamation cases need to be filed, so be it. If other SALN cases need to be filed... then let someone file them. If Congress blocks them, remember who voted and be sure to not vote for them next election...Last edited by niky; May 29th, 2012 at 11:31 AM.

ano po ba ang labag sa batas na ginawa ni cj para ma impeach cya? is it an impeachable offence? meron po bang kaso ng anti graft na nakasampa sakanya sa ombudsman o sa impeachment court? ano at saan cya nagnakaw? non declaration nalang po halos ang pinagtatalunan ngayon.... lahat naman po nasagot na ni CJ... ni ang prosecution nag waive na ng cross nila.... ayaw na din nila gamitin ang waiver.... pwede naman nila gamitin yun sa rebuttal but.... they did not... why?
alam nyo po kung may mali o nag nagnakaw po sa kaban ng bayan si CJ kami po dito ang unanang unang makakaalam at lahat po ng papeles eh dumadaan sa emplyedo... kami po dito sa JUDICIARY will not tolerate the CJ... like what we did to CJ Davide... the employees was the one who initiated the filling of the impeachment complaint against DAVIDE... halos lahat po kami sa judiciary anti GMA....

So based on this argument, if one gets pulled over for a traffic violation and is about to get issued a ticket, puede pala niyang tanungin yung enforcer, "Habang naka-duty ka, ikaw ba'y hinding-hindi sumalubong sa 1-way street? Ikaw ba'y hinding-hindi nagpatakbo ng sasakyan habang pula ang ilaw? Ikaw ba'y laging naka-helmet kapag nagmo-motor?"
Then, we really don't need courts, lawyers, plaintiffs, defendants and judges after all, right?

Qualify ko lang yan. Not all Cojuangcos were under fire during Marcos' time. It was during his time nga that Danding flourished and benefitted from the Coco levy funds. It doesn't automatically mean din naman that once mapalitan ang CJ, eh maging pabor na mga desisyon para sa admin.
Be that as it may, though I believe the CJ isn't up to the high standards of his current position... the verdict can still go either way. kasi kung 16 to convict nga... kahit maka-15 acquitted pa rin.
napanood ko nga yan. sabi nya sa mga HL farmers, tinaya daw nya buhay nya para sa kanila.

Ika nga ni enrile, ano ba mali kung disclose niya dollar niya. No court would file a case kung nilagay niya sa saln. Bakit kailangan itago? Bakit nagwaive sa cross is beyond me dahil hindi ako prosecution, much more, not a lawyer. Sa pananaw ko, kung walang tinatago, hindi kailangan magtago.
Nasagot niya, pero tama na palusot lang lahat. Babanat ng waiver pero kailangan sign din yung iba. Babanat ng walang condition at the last minute. Bumibira lang para humaba... Dami dahilan pero wala evidence to support, only credibility at best.
It does not follow na kung ang buong sc employees are not against the cj, wala siya ginawang mali.
hindi ba nasa article 2 ang basis ng kaso, included as articles of impeachment?
