October 22nd, 2018 03:12 PM #42while researching - stumbled upon this. diba nagbayad na ng tax nung binili yung car. may taxable ulit kay seller as income tax after selling.?
parang pag bumili ka ng laptop/cellphone/etc tas binenta mo rin sa iba, wala naman income tax
it may be different pero naisip ko lang.

Sa real property lang may ganyan, no matter how often the property exchanges hands and even when sold at a Loss, still a capital Gains tax is due.

October 23rd, 2018 06:50 AM #46Hi mga idol, naisip ko lang.
If yung first owner at ung 2nd buyer ay nag execute ng 1 unnotarized open DOS at 1 notarized closed DOS.
Then ung 2nd buyer binenta nya kay 3rd buyer ung sasakyan but gave the unnotarized open DOS.
Naka aksidente yung 3rd buyer, I assume 1st owner will be held liable kasi sa kanya naka pangalan ang sasakyan but since may copy sya ng notarizes closed DOS, may defense sya and proof na natransfer na yung ownership to 2nd buyer. Correct?
So ending, si 2nd buyer pa din ang hahabulin since may proof naman na sya ang bumili? So ang naisip ko sa open dead of sale ay ang risk ay nasa huling nagbenta using open dead of sale and not necessarily sa mismong 1st owner? Tama po ba?

October 23rd, 2018 08:08 AM #47so what do i-the-seller do?
forcibly bring the buyer of my car to the macro-etching center (twice!), and then to the LTO ?
ang dapat sanang patakaran, ay multahan ang buyer of used car, should they fail to transfer ownership within a given period, with confiscation of said car, should buyer fail to do so after 6 months.

Anong ginawa mo bro Qwerty? Di ba kung di mo naman papansinin, di rin marerehistro ng kung sino man ang may hawak at that time?
