Estrada-Tan part 2: DAP funds used to buy COA car
MANILA, Philippines – Is the car of the Commission on Audit (COA) the “quick-moving project” the budget department said it needed to fund with realigned allocations?
Senator Jinggoy Estrada raised this question after he got COA Chairperson Grace Pulido-Tan to admit that her agency was also a beneficiary of funds from the administration’s controversial Disbursement Acceleration Program (DAP).
After grilling Tan at a budget hearing in October, Estrada was not yet done interrogating the COA chief. This time, he brought his gripes against her to the Senate plenary deliberations on the COA budget late Monday night, November 25. The hour-long deliberations ended at 11:12 pm.
Estrada said, “Were DAP funds used to purchase the service vehicle for Commissioner [Heidi] Mendoza?”
Tan said yes and added that she belatedly found out that funds from the DAP were also used for COA’s purchase of computers and hiring of IT and litigation experts as consultants. She said the total allotment for COA that came from the DAP was P143 million. The COA chief clarified that she did not request that the funds come from the DAP.
“When we made the request earlier on in my term, I think DAP hadn’t existed yet. Our request was back in 2011,” Tan told Estrada.
Estrada though used her admission to question Department of Budget and Management (DBM) Secretary Florencio Abad’s statements about the purpose and use of the DAP.
He quoted Abad’s press release saying that the DAP was designed to ramp up spending and help accelerate economic expansion. “Releases from DAP were used for quick-moving projects that support the Aquino administration’s socio-economic development platform.”
The senator then quipped, “So isa pala sa project ng administration ay pagbili ng kotse to ramp up spending? Isa pala sa quick-moving project na sabi ni Secretary Abad ay pambili ng kotse?”
Tan curtly replied: “That’s already with the Supreme Court. I decline to comment. We did not raise the issue on the legality. What we are auditing is the utilization of the DAP."
Estrada said: “The COA cannot be objective in its audit on the propriety, legality of DAP when the agency is a recipient and beneficiary of DAP. Even if there is no irregularity, just the same.”
The Supreme Court is deliberating the legality of the DAP after petitioners and legal experts said that it is unconstitutional because it was not included in the budget and undermined Congress’ power of the purse. Critics called it “an invention of the budget department” and “a budget within the budget.”
Estrada then tried to imply that Tan violated a COA resolution by hiring her daughter as an executive assistant. Estrada cited COA resolution 2012-013 barring COA employees from hiring relatives.
Tan responded: “Can you please read until the end, up to the exceptions? It says an exception is when the appointment is confidential and co-terminous, which is the appointment of my daughter.”
At this point, Estrada decided to end his interpellation. The Senate finally approved the COA budget of P7.9 billion.

MANILA - Senator Juan Ponce Enrile is set to deliver his privilege speech Wednesday, one that is expected to be critical of reports surrounding his alleged links to the pork scam.
In an ambush interview, Enrile told reporters today: “Antayin na lang ninyo. I do not write good speeches but I’ll try…Factual lang ang sasabihin ko, all factual."
Enrile is one of three senators earlier charged with plunder before the Office of the Ombudsman for allegedly pocketing a big chunk of his pork barrel by conniving with businesswoman Janet Napoles.
Last week, a story came out in the Philippine Daily Inquirer, which cited a supposed Ombudsman initial finding that Enrile is the “mastermind” behind the P10 billion pork barrel scam.
Ombudsman Conchita Carpio Morales denied she received an 8-page memo containing this and other findings.
"I'm surprised about that 8-page memo. There's no such thing as 8-page memo," she said.
The Ombudsman was asked about the veracity of the Inquirer report, which said that an assistant Ombudsman submitted to her an 8-page memo stating that Enrile was the unseen hand orchestrating the pork barrel scam.
She said she had no knowledge of Assistant Ombudsman Joselito Fangon's supposed 8-page memo stating that it was Enrile, not businesswoman Janet Lim Napoles, who orchestrated the pork scam.
“Clearly, no matter how layered the scheme may have been perpetrated or unrelated the players may appear, all facts point to Senator Enrile as the unseen hand directing the compass and the tempo of the whole orchestra,” Fangon allegedly said in his memo, as quoted by the Inquirer.
Enrile asked her to look into the source of the report.
The senator’s office said the story was “merely the latest and most outrageous of a series of supposed leaks by the Inquirer, clearly intended to malign and defame.”
It said the report is part of a pattern to try him by publicity. “This is a violation of due process and a clear breach of journalistic ethics."
“Senator Enrile maintains his innocence and his determination to cooperate fully with the Ombudsman to bring to justice all those who are truly responsible for this scam,” the senator’s office said. – with a report from Ron Gagalac, ABS-CBN News

Customs chief Biazon, 33 others charged over 'pork' scam

MANILA, Philippines - The National Bureau of Investigation (NBI) on Friday filed charges against 34 individuals including Bureau of Customs Commissioner Ruffy Biazon for their supposed involvement in the alleged P10-billion pork barrel scam.
Justice Sec. Leila de Lima said in a televised news conference on Friday that among those charged were seven former congressmen including Biazon, who are accused of malversation of public funds graft and corruption and direct bribery.
The seven former lawmakers are:
Baterna Salacnib (1st district, Ilocos Sur)
Biazon (Muntinlupa)
Mark Douglas Cagas IV (1st district, Davao del Sur)
Douglas Cagas (1st district, Davao del Sur)
Arrel Olano (1st district, Davao del Norte)
Arthur Pingoy Jr (2nd district, South Cotabato)
Rodolfo Valencia (1st distroct, Oriental Mindoro)
Also charged were two representatives of congressmen, three heads and seven employees of implementing agencies, 12 resident auditors, Janet Napoles and two individuals from the alleged fake non-government organizations set up by the businesswoman.
Last September, the NBI filed charges against Napoles, the suspected scam mastermind, and 37 other individuals for their alleged involvement in the multi-billion peso conspiracy to divert lawmakers' pork barrel funds to fake non-government organizations and ghost projects in exchange for kickbacks.
Five lawmakers were charged for allegedly committing plunder in conspiracy with Napoles and officials of government implementing agencies when they each accumulated more than P50 million through a series of transactions over time through misappropriation, conversion, misuse, and malversation of the cash value of the project cost allocated from the lawmakers’ funds and through their acceptance of kickbacks or commissions.
The NBI said lawmakers received kickbacks from Napoles amounting to 40 to 60 percent of the cash value of the cost for every project endorsed by the legislator to an NGO of the businesswoman, who is also facing plunder charges.
"These kickbacks are the lawmaker’s bribe for giving undue favor to a Napoles NGO, or represent his illegally contracted share from a malversation scheme designed to misuse and misappropriate public funds entrusted to him, and which he appropriates instead for private gain rather than the public benefit intended by law," the NBI said.
Also charged last September were chiefs-of-staff or representatives of the said lawmakers, heads and officials of three implementing agencies, and several presidents of the NGOs supposedly set up by Napoles.
Napoles is currently jailed in Fort Sto. Domingo, Laguna due to the serious illegal detention charges filed by scam whistleblower Benhur Luy, who is also a relative and former employee of the businesswoman.
Earlier this month, Napoles testified in the Senate Blue Ribbon Committee hearing on the pork barrel scam, but she evaded questions and refused to divulge her knowledge on the controversy.
