since nag submit nang resignation letter.. wala kang dapat bayaran.. there's no provision in the Labor code na kailangan bayaran ang isang employee na nag resign..
the employee-employer relationship has been terminated so wala na syang habol don.

termination lang ang meron separation pay. grabe naman behavior and character ng magkakapatid na yan.

The only negative thing is during family gatherings. Tatampo mga yun at parang kasalanan mo pa.

April 7th, 2011 03:05 PM #15No she is not entitled for seperation pay. Why? because:
a.) there is no contract. She technically DOES NOT WORK for the company
b.) I believe that on cases of termination due to employee behaviour, misconduct, etc. all other seperation benefits are forfeited. But, as stated on letter a.) there is no contract. so di na aabot dito, even if umabot dito yun nga forfeited benefits na (well that is commonly included on the contract, hopefully contracts you gave to your employees have this).
c.) From what i know, seperation pay = number of YEARS you are with the company X monthly salary. so since she is only there for 2 MONTHS. wala pang seperation pay yun..?
Opinion ko lang po ito TS.
