Medyo magulo yata. Walang deed of sale between your friend and the buyer? Bakit sila pumayag na walang documentary evidence about the sale?
Anyway, since technically yung friend mo pa rin ang lumalabas na owner, and assuming that he has all the necessary requirements, (OR/CR, PN), then pwedeng palabasin nga na the buyer committed Estafa, kasi tinakbo na yung kotse at pinatalbog yung mga cheke. In essence, there was deceit. Pero since wala nga kamong dokumento, I don't think it will prosper.
Also, your friend has to contend with the imminent civil and criminal cases the bank will file (BP 22, Sum of Money and request for a writ of replevin). Pag may deficiency, he also has to pay that, aside from the accrued interest and penalty charges.
Maybe you could post additional details para mas kumpleto din ang sagot namin. For example, ano yung specific details ng agreement nila? (I would assume it's only verbal, since walang deed of sale)Last edited by Galactus; July 16th, 2007 at 07:44 PM.

it cannot be considered stolen. what you are really after is rescission of a failed sale if there was no deceit or estafa (swindling) if there was. in carnapping there must be taking without consent or through force/intimidation. you can report it as carnapped, but when the other party is able to show that they actually bought it, then there may be consequences.
dun sa acknowledgment of debt at promissory note, wala bang reference to the transaction, that it was for the sale of the car? ano nakalagay, "for value received"? if there was reference to the vehicle, then should be sufficient memorandum of the sale.
have your friend keep close to the bank and give whatever assistance they can to them because they have a lot of civil causes of action against your friend. unfortunately, it's also a crime to sell property under a chattel mortgage without consent of the creditor.
if you really want to file a criminal action (suggested: estafa), then you can either go to the police and report what is happening. they can investigate and file the complaint with the prosecutor. or your friend can narrate everything in an affidavit and file the complaint directly with the city prosecutor. based on your posts, there seems to be enough for the prosecutor to call for a preliminary investigation and eventually file an information.
but before doing so, i would suggest you also get to talk to bpi's legal dept re what action you will take. any action on your part might make it harder for the court sheriff to reclaim the vehicle when they foreclose.
mahirap talaga iyang sitwasyon ng kaibigan mo, there is no easy way out. another thing that is not clear is the reason for the refusal of the buyer to pay for the car, balasubas lang ba talaga and the evasion is with criminal malice or are they coming up with some sort of justification (whether tama o mali)? may natanggap ba kaibigan mo na pera as partial payment?

Nope. Hindi sya verbal meron sila pinirmahan promissory note to assume the balances katulad nung sa bangko na pinapipirmahan.
Saka notarized sya nang abogado.

kaya nga eh. kasi walang wala na sila kaya napilitan nila ibenta nakatanggap sila 80k lang sa nabayaran nila more than 350k na lahat lahat sa bangko.
Wala daw pera eh sabi tapos wala na hindi na nakipagcoordinate yung 2nd buyer.
Mukha balasubas lang talaga, naghihintay ata hatakin nung bangko na lang.
Nakalagay lahat dun sa pinirmahan nila na may natanggap na payment and then assume na nila yung succeeding months.
sori mga boys naaawa na talaga ako dun sa kumare ko eh.
naghihintay na lang talaga sila puntahan nang BPI.

We have bank loan confirmation and conditional deed of sale Which was notarized. After few weeks nag txt/call ako sa nag assume pero no answer at all. So I decided na puntahan siya sa address na binigay niya which is specified din sa mga ids niya. Malaman ko na non existing ang address na yun. Nag pa tulong din ako sa mga Brgy officials to locate pero non existing talaga. blotter po ako sa brgy nila. After few days may nag punta sa bahay namin at sinabi na victim din pala siya. Nag check siya din sa address na binigay pero wala din. Pareho ang Ids na binigay niya kay victim 1 at sa akin. Verify ko din sa lto ang lic na present niya. Lic num is valid pero hindi siya ang holder. Until now wala pa din po ako actions na ginagawa dhil hindi ko po alam kung saan mag uumpisa. Si original owner ang gusto bayaran ko ang car hanggang matapos ang 5yrs. Kahit wala na ang car. Eh hindi ko na nga kaya hulgan kaya pina assume ko. Ano po ba possible mangyare pag stop ko na hulugan ang car? Demand po ba ako ni original owner at ni bank? Ano naman po ang possible na maging defense ko.? expired na din po yun insurance. i really need help .. Thank you so much ..
