Personally, it's a very close call... technically, the gray car should be watching for incoming traffic, but if his view is blocked, there's little he can do. The big problem is the makeshift U-turns that the MMDA sets up are too narrow for most vehicles to make a turn within the assigned lanes... which is why they've put up signs banning trucks from using those lanes. Kung mabait ka, and you don't cut across to enter the U-turn from the middle lane, your u-turn exit is really wide.
The gray car, though, legally, is at fault, because he's merging. Pero mahirap habulin na yun if you don't have a police report.

i think red car had the right of way. gray car should have yielded. but both should have proceeded with caution.
why dont you try filing a case against MMDA for constructing the dangerous U-turn hehehe para may jurisprudence na PAG nanalo lang naman kayo.

AFAIK, dito sa Pinas, the one who is at fault generally is the person(driver) who has the last chance of avoiding the accident. Sadly, typically, ito iyong nakabunggo..... Grabe nga ito dahil kahit na mali ang nabunggo mo,- may tsansang ikaw pa ang "at fault".
Sa US,- hindi ganito, kaya walang maglakas loob na maging mali sa pagmamaneho. Minsan nga, may na-wrong way at kasakay ako ng isang puting driver,- sabi ng ibang puti ring sakay, "Hit him! Hit him!"....
Tingin ko, mali ang gray car,- una,- siya ang merging at pangalawa,- siya ang "nakabunggo" (driver who has the last chance of avoiding the accident)...

sa tingin ko yun gray car pero kung yun red car is a defensive driver dapat nag slow down na siya nun nakita niya na huminto yun black car, kasi ako pag ganyan ang situation, pag nakita ko huminto o nagminor yun car sa harap ko i always expect na may tatawid na tao o anuman dun. sa ganyan kasi hindi na kung sino tama o mali eh, yun makakaiwas nalang sa aksidente dapat ang unahin ng driver habang nagdadrive.
