- yung motor vehicle policy po natin ay Open Policy. Meaning, in the event of a total loss, yung insurance company ay mag bayad ng ACTUAL FAIR MARKET VALUE ng inyong sasakyan. Ang basehan po ng actual fair market value ay kung ano yung value ng sasakyan mo immediately prior to the loss, atsaka yung actual fair market value is subject to the sum insured which is the maximum limit for which the insurance company is liable.
kung total loss naman, yung depreciation clause di na mag apply.
Ang sa inyo po, na-renew nyo yung insurance mo sa February 2015 for 500k as the insured amount of your car then a month later nangyari yung total loss at babayaran kayo ng 400k kasi sabi sayo may depreciation. sa tingin ko po unfair yan. no.1, wasto po kayo na di naman mag apply yung depreciation clause. no. 2 , yung actual fair market value from the term itself must be FAIR. one month lang nakalipas 100k na yata na- deducted sa value ng sasakyan mo. generally, 10 per cent lang yung annual depreciation sasakyan natin.
ideally, within 30 from the time you have communicated your loss, magbayad na yung insurance company. after that, they are liable for interest.

Basta po yun insurance nyo ay tama sa fair market value nun time na ininsure nyo bale fully insured po kayo. Meaning at the time na ininsure nyo e 500k ang fair market value. Yun insurance po nag declare na total loss bale you should get around 490+k kasi po may kaunting less sa participation etc.
The insurer will try to offer you syempre the cheapest they think you will accept. If you deny it they up their offer until finally they get you to agree.
In this case d po tama na i withdraw nila yun declaration nila na total loss since siguro po 40% ang damage nang kotse nyo. Kaya you can reject again their offer and seek the help of the insurance commission to get a ruling in your favor as you feel that you are being short changed here sir.

Inquire ko lang po if incase for repair ang original na quote ng casa the insurance declared it as total loss and di kami nag-agree dun sa offer, pwede po ba namin i-insist na irepair na lang? salamat po!

it depends on the insurance company. few of them are pain in the a** kapag claims na but some are considerate. May I suggest you write a formal letter , mention your reason/s (with konting drama). i agree with confused shoes but at the end of the day its your call. Why do you want for repair instead BTW
