then afterwards,charge them with estafa...the dealer as it was your first contact and let them charge the one for whom they bought the car.

September 6th, 2012 11:32 AM #13if you have the time and money to spend, then find a good lawyer who could give you a very good advice on your next legal step to take.
however, i believe that when you buy a second hand car from a dealer, then it's on a "as-is-where-is" basis. meaning, as soon as money and goods changed hands and contracts are signed, then the sale is final. no warranties or guaranties. also, they can always claim that they where also duped by the previous owner. pero i am sure the previous owner will not tamper with the odometer kasi di nila alam yun. the dealer got a low priced used car with high mileage and tampered with the odometer to re-sell the unit at a higher profit.
again, your lawyer will be able to tell you if you have a case or not. kasi i believe toothless and dti against this market.
the best that you can do now are:
- spread on the social media this matter about this dealer para di na sila puntahan ng ibang buyers at ma diskubre ang panloloko nila sa mga customers. masira dapat reputation nila para wala na sila maloko. this is the next best thing you can do to get back at them if legal matters are not advised by your lawyer.
- try to appreciate your new car and do all the things you need to do (exterior, interior, engine detailing, replacing worn out parts, change engine oil, power steering fluid, atf, brake fluid, oil filter, air filter, aircon filter) so you will be using a car in tip top shape and avoid accidents that will add to your woes. Also, check the brake pads and suspension parts for any need to replace them.
by doing these things, then you will forget the mileage of your car and enjoy using it for years to come. SInce company car yan, i think that the car was properly maintained and still in good condition kahit mataas na mileage. Honda civics are good quality reliable cars.

As is-where is clause does not cover fraud, which appears to be the case here.

September 6th, 2012 03:33 PM #15Guys, thanks a lot for all your insightful comments. Laking tulong talaga. At least I was able to share this to you and nabawasan yung kinikimkim kong sama ng loob. But still, it will not end here. I realized that some of you want me to complain and some want me to just accept it para iwas hassle. Pero for me, I think I need to do something about this not only for me but also for other prospective car buyers. We worked hard for the money that we pay for the car, so it's just fair that we get equal value.
I called DTI earlier and told them my story. I was so glad to hear from them that I have a case. I learned also that they have lots of similar cases, which is really sad. The next step for me is to write a formal letter to DTI (I can send it either through email or visit them in their office) and wait for a maximum of 1 week for the mediation. So good luck na lang sa akin.
Magsilbing aral sana ito sa mga nagbabalak bumili ng auto, especially kung 2nd hand. Thanks sa tsikot members! I will update you kung ano na mangyayari sa kaso ko.

what if the car dealer says, "we didn't know that! it appears we were conned as well by the guy who sold the car to us!".
remember, it is you who will have to prove fraud on their part.
yes, it may be true that you have a case against the dealer. but it will probably be an upward climb all the way if you go to court... are you willing to go the distance?
perhaps if you can show that there are many other similar cases against this particular dealer..
by the way, what's wrong with the car? or, is there nothing wrong with it at all, except the mileage...?
if there's nothing really wrong with it, then i suggest you drive and enjoy it.
