Papatulong lang just to confirm ano ba traffic code natin with regards to overtaking? A friend of mine kase was involved in an accident. Basically, ang kwento nya pumasok sya isang residential area na 2-way pero 2 lane lang. Nung nasa curve na sya near an intersection he had to stop kase may paatras na sasakyan kase na nag mamaneobra sa harap nya. Nung patapos na yung maneobra nung sasakyan sa harap nya he inikabig daw nya yung sasakyan nya slightly sa left side kaso hinde nya napansin na yung nasa likod nya ni cut na pala sya sa left side nya yun tinamaan yung driver side ng sasakyan nya. Bali tanong ko sino ba at fault dito sya or yung nakabangga sa kanya? As far as I know kase bawal mag overtake sa mga curve, near sa intersection, or sa mga daan na less than two lanes on the same direction.
Sabi kase nung nakabangga dapat daw tumingin muna sya sa side mirror bago nya iniwas kotse nya.

Dapat talaga tumingin muna siya bago lumiko. That's a basic tenet of defensive driving.
Kahit pa no overtaking zone, your friend had the last clear chance to avoid the incident since nakasimula na magovertake yung kotse sa likod so he should have noticed it in his side mirror.
Also, bihira may explicit no overtaking zone sa loob ng metro manila. Mas common yan sa highway.

April 10th, 2014 06:21 PM #4from what i know, bawal overtaking on tall bridges or approach to such bridges, dahil hindi makita kung ano ang nasa kabila.
ang alam ko, ganyan din sa curving roads na hindi nakikita kung ano ang sumasalubong.
in your query, it seems to me, both are at fault. they were both attempting to do something not allowed by traffic law.

TRAFFIC VIOLATION AND ADMINISTRATIVE FEES AND CHARGES
Under Section H item r at t bawal talaga mag overtake near a curve or an intersection pero highway. Will that law still apply sa residential area?

Both parties are in the wrong, IMO. If your friend tried to veer left towards the opposite lane when he tried to avoid the car leaving the driveway, he/she also commited the same violation as the car who's already counter-flowing.
The LTO guidelines on this matter may specifically apply to highways, but I think the principle stands on any road with similar configuration and inherent risks.Last edited by oj88; April 10th, 2014 at 07:17 PM.

Kasalanan yun may paatras na sasakyan. Kundi sya naging sagabal, di sila bumangga.

Me rason ung umiwas kaya nagkasagian, but your friend has the better arguement kasi kita nya kung meron kasalubong. Suggestion ko ipasok na lang nyo sa insurance not worth the money and time just to stablish who is at fault.
