Child Restraint Act - bill requiring child seats in private cars

Nothing against this law but why penalize only those who can afford their own cars when the unsafety-ness of public transport is not being focused upon. Puro na lang ba sa private transport ang penalties?

BUHAY Party-list Representatives Mariano Michael M. Velarde, Jr., Jose L. Atienza, Jr. and Irwin C. Tieng want owners of private motor vehicles to install and use age-appropriate restraint devices for child passengers.

House Bill 5815 or the ‘Child Restraint Act’ - children who are passengers in a moving private vehicle must either sit on an age-appropriate crash-tested seat or use a device/system that is specially designed to provide child crash protection.

Adults in violation of this law will be fined Php 5,000 or imprisonment of not more than 30 days, or both.

"Pursuant to this policy, and emphasizing that safe driving practices and proper use of safety devices remain the best way to protect children from traffic crashes and injuries resulting from vehicular accidents, this measure seeks to penalize any driver of a motor vehicle to travel with children on board without providing for a safety device for such children," Velarde said.

Rep. Tieng is also added that after two violations, the adult’s driver’s license must be revoked and he/she will be prohibited from getting a new driver’s license for 12 months from the date of conviction.

The bill also declares it unlawful for any adult accompanying any child or to allow such child to travel on a motor vehicle that does not have car seat or child restraint device for children unless the adult provides one for the child's own use.

Any person who violates this provision shall be punished with a fine of Php 2,000 or imprisonment of not more than 30 days, or both.

The Land Transportation Office (LTO) will be tasked to approve all child restraint devices, implement and supervise the enforcing of the mandate.

Public utility jeepneys, buses and emergency vehicles are not covered by the bill.

Exactly my point brod. Para sa safety naman to ng mga anak natin at to be honest meron naman kaming child seat kahit mahal bili namin. Safe nga kami pero wala namang nagchecheck ng preno ng mga jeep at trucks natin. Kahit saan daanin, walang laban yung subcompact namin kahit isang dosenang childseat ang gamitin ko pag binangga ng truck na "nawalan ng preno".

Nakaganyan ka nga aararuhin ka naman ng mga trak at bus na bulok wala din. Sana unahin na lang nila yung mga jeep at bus na walang seatbelt para sa mga pasahero, yung mga jeep na siyaman lang pero nagiging pang labing isa. Haay naman.

I also invested in a child seat several years ago. But then, this is a law that only applies to private vehicles. What about school buses/services? Parents/Adults taking the bus, jeepney, or taxi with their baby or toddler?

If the intention here is to save the lives of children, why is this law seem to only appliy to private vehicles?

Imagine these scenarios:

1. Private vehicle: A 4 year old seated and strapped to an adult lapbelt at the back (ie. no child seat) gets a P5,000 fine and/or a 30-day prison sentence
2. PUV: The same 4 year old is sitting on an adult lap (kandong) or the standard seat without ANY restraint, and the driver/parent is not liable for anything

If that's not double standard, I don't know what is. This law is a good example of misplaced priorities, IMO.
