Happened last November 2013 tapos may resolution na agad? Something fishy kasi hindi ganon kabilis yun. First letter na dapat mo matanggap is subpoena because you need to answer their affidavit stating your side. Usually after mo pa nga magsubmit ng counter affidavit eh magsusubmit ulet ng another counter affidavit yung kabilang kampo. Been in this kind of scenario but i was the one who filed a case against the other party and the resolution was only made after two years. At the end, we agreed to settle amicably on a much lower price just to terminate the case and move on with our lives.
FYI, the only evidence they can present to court will be the photos taken on the scene of accident since wala naman police report or any other documents in writing na pinirmahan mo. Unfortunately, that alone may be used against you.
Suggest ko na lang since may contact number ka nung kabila, is kausapin mo and clarify bakit biglang nagkaroon pa ng case. Malaking abala lang yan sayo, sa kanila at sa korte kung magtutuloy.

December 6th, 2015 08:18 PM #12Our driver had an accident a few months ago, damage was minimal, around 20k from toyota's assesment, i paid the participation fee, a few days ago i also got demand letter from the issurance. Im thinking of paying the said amount to get it over with but something in me is saying not to, coz of principle, thinking thats what insurance are for and they are just being greedy. Dapat sa casa ako nag bayad, btw, i fired the driver already and the vehicle is under my name. Any inputs? Thx

all the rights that the injured party may have against the person causing the damage is now transferred to the insurance company.
obviously, the injured party did not claim it under the "own damage" provision of his insurance policy because the insurance company is now going after you.
you better go to that insurance company and verify before they will invoke judicial process to compel you to pay.
