sa mediation sir sa DTI lahat po iyan sinusulat tapos pinipirmahan ng both parties witnessed by the DTI mediator, then meron copies lahat. yung sa road test at evaluation sir ng elantra sana lumabas lahat ng nakatagong problema mas maigi naka sakay din kayo para agree sa lahat ng makikitang problema.

September 5th, 2013 01:15 PM #313well looks like the mediation went off fairly well... congrats maimaicomp! Pero fingers crossed pa rin and real congratulations will come pag nakabit na talaga and wala ng ibang issues ang Elamtra mo.
Its just sad that vehicle owners have to resort to these measures to get results.
thanks nga pala for replying to all my queries on the previous page. Gave us a better understanding of what went down.
btw, did HARI have a rep that attended the meeting? You metioned Rudy and HNE warranty head lang. Makes me wonder why they (warranty head) are still resisting at this point.. and makes me surprise that HARI just doesnt step in and say "Hey, this is giving us bad press, here's the part, just install it and get it over with"
From my understanding, all warrantabe part replacements are paid for by HARI right? No cost for the casa? Labor lang provide nila? So all they need is HARI's go-signal... am i correct?

Just out of simple curiousity, madali lang ba mag request ng ganitong mediation with DTI? Do you need a lawyer? What steps ba gawin dapat?
Iniisip ko before with literally millions of products sold in the Philippines of varying price, size and function, e kahit 1% lang ang magreklamo everyday e di fully booked na ang DTI sa mga ganitong kaso. Pero siguro most everyone dont even bother reporting because of the hassle. And only cases like this na you are dealing with close to or even greater than a million pesos worth of product (car) will a consumer feel motivated to take action. (And hindi pa rin lahat , some would still just sigh and let it go)
Would be nice to know this info in case some of us will need to resort to DTI intervention too in the future.. but hopefully di na dapat humantong pa doon.

kung repair e naayos yung kalampag, ok yun, pero kung repair tapos bumalik yung kalampag, dun na papasok yung "replace".. since matagal na nga yung sira, dapat replace na talaga. sabihin mo, repair kayo ng repair e hindi naman nawawala yung sira. baka madamay pa yung ibang parts at lalong dumami gagawin nila.
ask lang sir, halimbawa nag delaying tactics na naman sila (more than the september deadline) or nagcycle na lang ang issue na hindi nila papalitan and whatsoever, so may adjudication na nga, pag natalo sila dun ano ang gagawin or penalty nila?
kasi kung manalo kayo at ang hatol e palitan nga yung mga parts, tapos uulit na naman na "pinalitan" na nila pero hindi..

madali lang magfile ng complain sa DTI, hindi na kailangan ng lawyer, gawa ka lang ng detailed comlaint affidavit, then attach mo lang mga supporting documents and evidences tapos send mo sa email ng consumer protection division ng DTI, within 7 days magpapadala sila ng notice of mediation through email kaya dapat lagi mo icheck email mo.

kinausap ko yung isang mediator ng dti at tinanong ko "what if hindi na naman sila tumupad sa napag-usapan, like what happened during the first mediation?"...he replied with "if the 1st and 2nd mediation is unsuccessful, they will forward it for adjudication, parang MTC or RTC ang function nila, they could impose a refund or replacement of the unit, we have sheriffs to do that part, ang pinagkaiba lang namin sa real court is that hindi kayo nakakapag-impose ng damages." that clearly explains to me kung ano na ang mangyayari kung sakaling hindi pa rin sila tumupad sa usapan. hindi na din kailangan ng lawyer sa adjudication process.

Pansin ko lang kaawa-awa naman ang email add nila... *yahoo.com, wala bang Dti.gov.ph address? tsk tsk kawawa naman ang Pinas....
Ayun,. 1st mediation unsuccessful... 2nd na yan... if palpak pa rin e may chance ka na for refund or replace unit...

madali lang magfile sa dti, in my case kasi ako representative ng company na inireklamo, kapag meron ng mediator kasi lumalambot ang matigas na tinapay eh, both parties mabibigyan ng chance na magexplain then iweweigh nyo pareho kung ano pwede maging compromise nyo para win-win situation. i guess sa malalaking companies talagang meron ng budget para sa mga cases na ganito pang damage control ika nga, also another tip lang kasi since yung ibang company nagmamatigas mga yan, kumbaga pahihirapan ka muna bago sila bumigay ewan ko kung bakit ganun sila pero since me resources sila ginagawa nila, pero saken in the end bnigay din namen yung gusto ng customer pero hindi lahat
