    Forum rule I haven't read any... As for legal implications I doubt there is any. Why? Everyday just by watching 6PM news they always show accidents and even the people behind it they interview. So I guess it also applies in the net.

    If this were to go to court, I'd have to side with the Civic. RA 4136, which lists the legal rules on rights of way, states:

    Section 43. Exception to the right of way rule.

    (a) The driver of a vehicle entering a highway from a private road or drive shall yield the right of way to all vehicles approaching on such highway.
    Highways are also defined as

    (j) "Highways" shall mean every public thoroughfare, public boulevard, driveway, avenue, park, alley and callejon, but shall not include roadway upon grounds owned by private persons, colleges, universities, or other similar institutions.
    Even if the Montero had a right of way, it was obligated to give way to the Civic because it was entering a public road from a private road. On the other hand, I believe both of them took too much of a chance when the inconvenience could have been avoided by simply delaying themselves for a few seconds.

    sir tidus1203 galing ba basement yung MS? if galing sa basement wala ka talaga makikita sa right side kahit kasing laki pa nya yung padating na sasakyan.. kaya nagbakasakali na lang siguro si MS

    sa shangrila mall parking paakyat right turn yung ikot hindi mo makikita kung may padating, bubulaga na lang dahil sa sobrang nakatingala na ang MS

    Yeah we can always argue who is right or wrong. But as far as the law and the police goes its the MS's fault kasi galing sa private parking lot...

    bukod sa right of way, kita namang nauna na yung civic sa montero, i guess the civic thought na hihinto si troy, malay ba nung civic na di pala tumitingin yung montero?

    And muka naman talaga takaw aksidente yung driver ng civic na yan...look at his rear left tail light....may tama na....may pagka barumbado siguro talagang magmaneho....

    ah ganun na ba rules sa kalye ngayon? titignan mo yung mga driver ng sasakyan kung matanda o bata? pati yung kotse kung bago o luma? at kung civic at naka shade eh g*gong driver na?

    akala ko malinaw na sa TS na umamin na yung driver ng montero.

    i dont get it. bakit marami na nagsasabi na kasalanan ni civic/montero based on a picture??? di naman alam ang buong istorya. it does help para malaman kung ano nangyari pero di lang dun kailangan tumingin.

    from a 3rd person point of view with absolutely no interest in the matter and who did not see the incident happen , i'd say things are not looking good for the civic driver. consider: the montero is new so it presupposes more caution on the part of the montero driver. the civic, by the looks of it, screams ricer/racer. so judging on appearances alone, the montero could've gotten scott free. until he made the mistake of admitting fault which of course is the admirable thing to do
