February 3rd, 2009 01:43 PM #1any resident lawyers here? actually kaso po siya ng isang HSmate ko. pwede po bang paconsult via PM na lang? i'm not comfortable with disclosing the facts since i'm not directly involved naman. pasensiya na po, likas po sa akin ang pagiging paranoid B)
basically nainvolve kasi siya sa traffic accident -- me narear end siya on the fast lane . the driver clearly went on full stop kaya nabangga niya. damage was relatively minor, and nakipag areglo na siya, so he was quite surprised to get a call from the traffic investigator, who elevated the case to the fiscal.
tingin ko malabo ung kaso, pero, no offense to anyone, alam mo naman ung mga nangyayari dito...

Kung na-areglo na yung kabila, malamang may masamang balak yung traffic enforcer. However, it would be best for your classmate to attend the scheduled hearing at the fiscal's office. From there you will know the basis of the complaint and the intention of the complainant. If ever, it will just be the first step to a very long process which time you may use to settle the same amicably. Although, the general rule is that criminal cases are not subject to compromise, quasi-delict like acts of criminal negligence are usually allowed to be settled. Bawas trabaho din naman yan sa mga fiscal.

March 25th, 2009 11:40 PM #4to clarify things, ung classmate ko po ung sinampahan ng kaso...while i feel he has a strong case, he has opted to settle para wala nang gulo.
paclarify lang: once both parties agree to settle at the fiscal, and the motion to desist(tama ba terminology ko?) is signed, can the case be revived in the future? my understanding of it kasi is that once magsettle na sa fiscal, patay na ang kaso.
and is it true that once the fiscal throws it out, pwede pa raw ifile uli, or iappeal?
parang lumilitaw kasi ngayon, parang mas OK pa ata na magkademandahan talaga kesa makipag ayos sa fiscal.
sino po pala ang magdradraw up ng motion to desist? Ung fiscal po ba mismo or the plaintiff? di ba dapat me standard format na siya?

kung maayos naman ang settlement bakit pa ir-refile ng complainant? for peace of mind, the parties can each have a copy of the affidavit of desistance.

Ganito po kasi yan ( lawyers paki correct kung hindi 100% accurate - paralawyer lang kasi ako ala Rainmaker lol , kung naisampa na ang kaso pero may affidavit of desistance na ang complainant, pipirmahan yan ng fiscal with the concurrence of the Chief fiscal sabay gawa ng motion to dismiss. Eto ang kailangang i grant naman ng judge kung saang branch naka assign ang kaso mo.
kung isa lang ang complainant at nag "desist" na siya, i see no reason para matuloy pa ang kaso. pero pwede matuloy iyon kung may iba pa palang complainant ( halimbawa, ung nabangga mo umatras na, pero ung nadamay na iba/property damage naman ng ibang party ang biglang naghabol, pwede tuloy ang kaso )
re: naman sa re-filing, make sure included sa affidavit of desistance ung portion na may instruction to "dismiss with prejudice" para naman protection sa inyo at hindi na uli mafile ang same case.
the fiscal in charge usually prepares the affidavit of desistance. they need it din kasi to cover their ass.
ps simpleng traffic case lang naman yata yan wag ka na kabahan basta importante makakuha ka ng affidavit of desistance. kasi may mga cases na pwedeng hindi i dismiss ang kaso kahit na nga ba umurong na ang complainantLast edited by rst619; March 26th, 2009 at 02:02 AM.

one other question: pagkasabi ng friend ko, wala daw kasamang attorney ung complainant nung nagkausap sila sa fiscal; is this normal? re the affidavit of desistance, do both parties have to have their attorneys present, para malinis?

usually fiscal ang abugado talaga ng complainant ( kaya nga tawag sa fiscal ay public prosecutor ).
dun naman sa affidavit of desistance usually ok na un pero mabuti na din ipabasa mo muna sa lawyer ng side ninyo.
