Ever since a "Talipapa" was constructed in front our house, trikes and mc's love to park on our driveway. Actually, my neighbors' driveways are also bothered by these nuisance. They impede our freedom of movement. I am aware that there is a law that should protect homeowners from such : RA 4136. And with the DILG's order to LGUs to get rid of obstructions, I believe that these blockers can be also considered as obstructions.
We sought the help of our barangay and municipal authorities regarding this matter but they just threw fingers at each other on wether who's responsible in dealing with our problem. Worse is 1 enforcer even told me that they have many tasks to do and guarding our gates is not one of them. The nerve!
Well, obviously, we hit a dead end on our quest for a solution on our driveway problem. Any advise will be highly appreciated. Thanks!Last edited by jjmd3_787; September 14th, 2019 at 12:58 AM.

For the meantime, pwede lagyan nyo ng kadena or any obstruction yung driveway para hindi paparking kasabay yung sign na dont block the driveway... cons nito is, always nyo tatanggalin kapag papasok or lalabas... else kilalanin nyo yung parking boys, abotan nyo para walang mag park... [emoji1787]... yun lang na isip ko na descent solution other than flat tire lahat mag papark sa harapan nyo.., hahhaa

September 14th, 2019 08:17 AM #4Write a complaint sa baranggay to do something about it. Have them receive the complaint. Kung wala ginawa, escalate to city hall. Again documentation is key amd provide pictures.
Kung ayaw talaga at walang ginawa both cityhall and baranggay, go to dilg.
I wouldnt be surprised kung makati yan. They have double standards here. Kung mahirap pagbigyan. Kung middle class, maarte lang

September 14th, 2019 08:33 AM #5Residential area ba? Pwede nyo check kung anong klaseng zone yung area, para sure kung allowed ba yung tinayo nila or nde. Baka kulang ng permit at pwede ipasara
Lagyan ng paint marking sa curb na "no parking or tow away zone"
Public road, try contacting MMDA to remove obstruction.
Buy an old vehicle or tricycle and park it on your driveway.

Personally, I would first find out kung may permit yung talipapa na ginawa malapit sa inyo. Baka yan yun mga na-displace na nawalan ng pwesto kaya bigla na lang nagtayo dyan. You can definitely file a complaint with the barangay first, pero malabo na hindi nila alam yan at baka connected pa kay kapitan ang nagtayo dyan.
Kung walang mangyayari sa complaint nyo, maglagay na lang nga siguro ng harang sa harapan ng driveway nyo para hindi sila makapag park.
Seriously though, may zoning na pinapatupad at hindi naman sila pwedeng magtayo ng talipapa kahit saan ngayon. Good luck, let us know how it works out.

Wala pong parking biys sa amin. At nalagyan na po ng barikada sa harap ng gates namin noon pero tinanggal ng brgy officials recently kc may DILG order daw. Ang problema ay mali ang pagkaintindi nila sa RA 4136 tungkol sa driveways. Tinuring nila na kaming mga residente ang nag block ng driveway nang dahil sa mga barikada na hindi naman sagabal sa daan. Pinapanood lang nilang mapuno ng pumaparadang trikes ang harap ng gate namin.

Nasa probinsya po kami. 1st class municipality naman. Nagkaproblema lang kami nang magtayo ng talipapa sa kalye namin. Napakaraming violation po ang pagtatayo nito: una, bawal ang talipapa sa isang bayan na may existing public market; pangalawa, itinayo po ito sa mismong daanan na labag sa pinatutupad na clearing ops ng DILG; pangatlo, ang mga pampublikong lugar kasama na ang kalsada ay hindi pwedeng pagkakitaan ng sino man (beyond the commerce of man).

Ang masakit po ay mismong driveway namin ay nilagyan ng paint markings as parking slots. Wala po kasi kami noon sa bahay nang gawin un kundi ay hindi kami papayag. Natawagan na namin ng pansin ang munisipyo pero wala silang ginawa. Napakahirap pa namang burahin ang rubberized paint sa pavement.
