    I've just read the thread on what to do when involved in an accident and I remembered this several incidents which happened while I was parked on a favorite parking lot and wondered, "What should I do next time this happened?"

    I just finished my clinic and when I went to the parking lot to get to my car, I noticed a big dent on the passenger side of the back of my accord with deep gashes on the paint and the side bar was malformed. I immediately went to the parking lot attendant and asked what happened to my car.

    He said it was hit by a young man driving a pickup while they were backing up. He immediately showed me a paper where he copied the other person's license number which included the name, address, home phone number, cell phone number and home address.

    I immediately called his cell number and talked to the guy. He admitted it was his fault and asked me if I can go to QC (I was at Makati at the time) so he can have it repaired by his mechanic. I told him it was too far away from where I live and work. He asked me for a quotation and, trusting him, told him I'll get it from a repair shop I frequent. I didn't have comprehensive insurance then.

    The next day I took a leave from my work and went to the shop to get an estimate. I called up the guy again and relayed the quotation. I even told him could fax him the print-out from the shop.

    Sabi nya okay na yun and asked for my bank account number so I gave it to him. He told me I'd have to wait for a month coz he applied it on his bank as a loan. Trusting the guy, I told him okay.

    A month went by and he still hasn't deposited the payment so I called him up again. Aba, sya pa ang galit! "Bakit, hindi pa naman tapos ang buwan na to a!" he told me. I said I'll ask again on the first week of the second month after the accident.

    The week came and I texted him asking why he hasn't deposited the amount yet and my car's paint really needed to be fixed since it's a sore on the eyes, not to mention rust could be starting to form.

    After a week of not answering, I called his cellphone: not in service daw. I called his home number, lagi syang wala doon.

    Hay naku. Pinagtaguan na ako.

    What do you do when you're in a case like this? It seems I did all the wrong things.

    Case number 2:

    This has been a frequent occurance in my favorite parking lot in Makati ever since it became a station for the shuttle service going to Cavite.

    Once I found the right tail light was broken. Basag yung plastic tapos nagkalat lahat ng pieces sa ground. I confronted the parking attendant and he said di daw nya nakita kung ano ang nangyari.

    Next there was appeared a large area on the right side of my rear bumper kung saan tanggal lahat ng pintura, mukhang natamaan tapos bumalik lang sa shape nya yung bumper. Again, wala daw napansin yung attendant.

    NExt sa front bumper ko naman. Yupi yung license plate ko tapos tanggal din yung pintura sa bumper na mukhang nakayod.

    I decided to get comprehensive insurance after that.

    If this happens again, what do I do?

    Do I call a traffic enforcer or policeman so they can document the damage and positioning of my vehicle? Di ba kailangan ng accident report when I claim it on my insurance?

    That's the difficulty of not having a comprehensive insurance coverage. If you had one then you could just pay your participation fee and let your insurance company run after that guy.

    If I were you it's most likely difficult to run after this guy who is obviously hiding from you, I'll just have my ride fixed get the official receipt and still try to contact or go to his address with a lawyer, but this would be costly on your part, or you could go to their barangay center and file a complaint then have their official go with you to the guy's place to have a confrontation. Charge this to experience, and these things happen. Good luck.

    Based on this I suggest you find another parking area for your car, these attendants even if they noticed what happened absolve themselves by having a condition in their receipt " The management is not responsible for any damages while it is parked in the car park ".


    When this happens inside a private area like car parks, the 2 parties must be present (driver who bumped the car and the owner or driver of the car bumped). If the driver who bumped you just left without any agreement then consider this as a lost cause na. Just have your insurance fix this like what I posted above. If the driver did not leave and waited for you then you could both settle or reach an agreement on how to fix the damage, or you could call the security force of the car park and let them document the accident and ask your insurance if they could accept this for a claim. Hope this clarifies your concern.

    nope! it's not a valid contract since you didn't agreed on the stipulated provision in their receipt, you didn't singed it did you?

    they and you can claim against the parking lot's insurance...ayaw lang nilang gawin since it will be a hassle to them....

    even in hotel valet services, they are liable to damages happen to your car while parked at their area..I know someone personally who had his car damaged while park in a basement parking of a big hotel, he had his car valet and the hotel paid for all the expenses for the repairs...

    What do you do when you're in a case like this? It seems I did all the wrong things.
    I'm no sure kung pwede pa pagawa ng police report considering 1 month na natapos, but I'm suggesting that you filed a report sa LTO as hit and run since you have his car details, so para hinde siya maka register until ma settle niya yun problema niya sa iyo...then that is the time na pahirapan mo rin siya...

    did you get his driver's license details? kung meron ka nun pwede ka mag complain sa LTO.

    since meron ka ng comprehensive insurance, just take a picture of the incident and gawa ka lang ng notarized affidavit, then submit mo na together with the other documents (OR, CR) sa insurance that's it...it will be entered as "own damage" sa insurance...if bago pa naman yun car mo then go to the dealer and have the damage estimated, then submit mo na rin yun estimate sheet together with the other documents...

    I didn't know I could've reported him to LTO...! Ayang naman.
    Napahirapan ko muna pala sana yung mokong na yun dati. After nya ko pgalitan I considered it as a los tcause na. I even thought na style yata yung papahintayin mo ng one month para di na makapag-file ng police report.

    Anyway, I just threw away his details and forget about it.

    What I learned from these experiences is: always get comprehensive insurance.

    So next time na tamaan ulit ang kotse ko sa parking lot at walang umaamin as usual, I just take pics of the damage, prepare an affidavit stating the reason there's no police report, and send it to the insurance company together with the other pertinent documents.

    you should have reported your case to the police immediately, either with the traffic sector department of the nearest police station or with the HPG or the Highway Patrol Group. both of the parties to the accident, which includes complainant and the accused, must state in an affidavit their own side. it is a criminal matter. the perpetrator can be charged with reckless imprudence resulting to damage to property under the Revised Penal Code.

    it might not be too late. ask the help of a competent lawyer so that proper charges may be filed with the Prosecutor's Office if he will refuse to pay his indebtedness.
