My car no longer has comprehensive insurance. A few months ago, my wife was driving it when another driver side-swiped my car's left side mirror which damaged it beyond repair. The driver of the one that hit my car insisted they just exchange details and not go to the police station anymore to avoid any additional hassle. She said that she will just let her insurance take care of the damage and that she is used to these kind of minor accidents as she works for Mitsubishi. She lives in the same community but just on a different condo property. She asked my wife to ask for a quote from the casa and send to her as we said that we want the casa to be the one to fix this.

After a few days of providing the necessary documents, the driver found out that her insurance no longer has Motor Image (Subaru cada) as an an authorized repair center and that they have their own authorized repair centers that I can go to. They gave me Atlanta Motors QC as one of those repair centers.

At first, I was a bit disappointed because the original agreement was for the casa to do the repair but I let it slide because she told us that this repair center is premium and all. So we said OK.

I then talked to whoever was in charge with the driver's insurance and the repair center. They told me that since my car is a 2018 model, the replacement part will just be a surplus and not a brand new one but is as "good as new". I said OK.

    Questions:

    1. Was I right to not push the driver at fault to make a way (maybe shell from her own pocket) just to have my car serviced at the casa?

    2. Can I ask her for compensation of gas, commute fee when I bring in my car for repair and get it back after completion, etc.? I'm from Taguig and the repair center is in Congressional Ave. QC and the cost of Grab to and from will cost me money.

    Thoughts? Thanks.

    might i recommend an alternative...
if all that needs is replacement and no sheet metal repair,
and if your car is popular enough with non-special side mirror, as to have surplus or even new side mirrors literally just hanging around, begging to be purchased,
    have you considered non-expensive-shop repair?
even the banawe or evangelista boys can probably install these, at a fraction of the cost of these casas, and the entire process will probably take less than an hour.
side mirror replacement is akin to playing with lego.

you can ask for compensation for "inconvenience" , but your satisfaction is probably entirely up to the other party.
you may sue, but i am supremely confident, the cost of litigation is going to be so much more than the cost of your inconvenience.

    alas!
most insurance companies require the police report, as part of their must-have-documents.
i do not know how the insurance contract of the other car will work for you...

    rule number one,
"never enter into an arrangement with anyone, that might be interpreted as an agreement, without the knowledgement and approval, of the insurance company."

Well, why not just go with their Atlanta Motors insurance then? I think it would just have the same quality as the ones in Banawe, no? I think I already came to terms with that option. My only concern now is, yes, the "inconvenience" I will have to pay when going to and from the repair center without a car. I guess I could try to ask the driver. Won't hurt to try.

It seems like you made a reasonable decision to go with the suggested repair center, especially since the insurance is covering the costs. While it would have been ideal to have the car serviced at the casa, it’s likely not worth pushing further, especially if the repair center is reputable. As for asking for compensation for gas or commute fees, it’s not typically expected in situations like this. However, if you feel it’s necessary, you can politely ask the driver at fault. It’s unlikely to be covered by the insurance, but you might be able to work something out directly with the driver. If you’re concerned about the repairs, a Smash Repair shop could provide more insight into the quality of the work at the repair center.
