is it possible, that they (the bank) misplaced the cheques?
if you have documentation that proves that the bank has the pdcs, you can show that bank the document, to prove to them that it's actually their fault...
unless!!! someone closed that account...! and the bank can't contact the boss, because the boss'es last-known address is the old one...

Ayun na nga po. Bka po kasi hindi nmn sa bank officer naipareceive ang checks kasi imposible nmn po eh. Hindi po kaya negligence na to, kasi po yung pondo nmn po is andun pa sa banko.

nung nagpunta po samin ung taga external office sabi po ay wala dw po natatanggap na checke ang banko from 2015 to 2017, wag ndw kmi marami sinasabi hahatakin nlng dw nila sasakyan this week. And opo untouched po ung account kung saan nakalagay ang para sa monthly amortization for 2 years na sinasabi po.

EQ's point is about your boss not knowing that the checks have not cleared. 1 year worth of PDCs that did not clear the bank is substantial enough not to be noticed. I am guessing the total would be around P150k to P200k so your boss should have noticed it unless there are millions in the bank and your boss is not tracking his balance. Anyways, try to negotiate and show good faith that your boss is willing to pay the balance through loan restructuring. Good luck.

so the question begs, "where are those pdcs"? as EQA in # 16 said, those pdcs are requirement before the deal is signed and the car is released.

Normally kung nag issue ng PDC's by bulk ay may acknowlegement receipt indicated doon ang cheque number, amount and date.

Yang external office na binabanggit mo ay malamang subcontracted ng bank, isang kumpanya na ang trabaho lang e i-recover at gulatin ang mga hindi nakkabayad.

If I were your boss, i'd let the recovery team visit the house then don't release the vehicle instead give them the copy of bank deposit slips and acknowlegement receipt of PDC's. If you can prove that your'e in good faith, pede mo pa kasuhan ng harassment. Ask your lawyer na rin.

Nakakapagtaka din bakit yung compre insurance hindi nyo finurnish ang bank? Diba yearly renewal yun at required ng bank nasa mortgage contract? Last June lang effective ang old cheques at dapat naabisuhan din kayo ng bank na palitan ng new cheques.
